Terms and Conditions

These Terms and Conditions ("Agreement") govern your use of the AtYourStep Services Marketplace ("Platform" or "App"), operated by AtYourStep Services Inc. ("AtYourStep," "Company," "we," "us," or "our"). By accessing or using the Platform, you ("Customer," "you," or "User") agree to be bound by this Agreement. If you do not agree to these terms, you must not use the Platform.

1. Combined Agreement

These Terms and Conditions, together with the Contractor Terms and Conditions available at https://www.atyourstep.ca/contractor-terms-conditions, form the complete and binding agreement governing all services facilitated through the Platform. By using the Platform, you agree that both sets of terms apply to your interactions with Contractors and your use of the Platform.

2. Definitions

  • Contractor: An independent professional providing services through the Platform.

  • Service: The tasks, work, or services requested by Customers and provided by Contractors through the Platform.

  • Platform: The AtYourStep mobile application and website that facilitate the booking and management of services.

  • Quote: The price provided by a Contractor for a specific service request.

  • Booking: A confirmed request for services made through the Platform.

  • Chat: The conversation taking place inside the platform.

  • Premises: The location where the services are to be performed.

  • User Account: The account created by a Customer to access the Platform.

3. Acceptance of Terms

By using the Platform, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you are under the age of majority in your jurisdiction, you are prohibited from using the Platform.

PLEASE READ THIS AGREEMENT CAREFULLY AS IT CONTAINS IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS. THESE INCLUDE, BUT ARE NOT LIMITED TO, VARIOUS LIMITATIONS, EXCLUSIONS, AND INDEMNITIES.

4. Overview of the Service

The Platform acts as a digital marketplace, connecting Customers with independent Contractors for the provision of specific services. AtYourStep does not directly provide services or oversee the quality, timing, or execution of services. You acknowledge that your contract for services is directly between you and the Contractor, and AtYourStep is not a party to that contract.

5. Requesting a Booking

  1. Service Requests: You may request services by providing accurate and complete information, including the location, timing, and specific requirements of the job.

  2. Quotes: Contractors will provide quotes for the requested services. You are responsible for reviewing and accepting the quote before the booking is confirmed.

  3. Chat: The Chat inside the platform is considered an integral part of the provided quote and includes the record of details and agreement between you and the Contractor.

  4. Confidentiality: Contractors will have access to your name, phone number, and address solely for the purpose of fulfilling the service. This information must be treated as confidential.

6. Customer Responsibilities

  1. Provide accurate and complete information when booking services.

  2. Ensure the Contractor has safe and accessible access to the Premises.

  3. Ensure that either you or a representative (18 years or older) is present during the service, unless otherwise agreed.

  4. Pay for all services as outlined in the accepted quote.

7. Payments and Fees

  1. Payment Processing: All payments are processed through Stripe.com, the Platform’s designated payment gateway.

  2. Pre-authorization: Service booking is guaranteed through a credit-card hold for the full amount at the time of booking.

  3. Release of Payment: Payment to the Contractor will be released only after you confirm on the Platform that the services were completed to your satisfaction.

  4. Sales Tax: Contractors may include applicable sales taxes in their quotes. You are responsible for all applicable taxes.

8. Cancellation Policy

  1. Cancellation by Customer:

    • Unguaranteed Bookings: May be canceled without charge.

    • Guaranteed Bookings:

      • Cancellations made at least 6 hours before the start time are free of charge.

      • Cancellations made less than 6 hours before the start time will incur a fee equivalent to one hour’s booking cost, plus applicable taxes.

  2. Cancellation by Contractor: If a Contractor cancels a booking, you will receive a full refund.

9. Disputes and Complaints

  1. Dispute Resolution: If you have a dispute with a Contractor, you must first attempt to resolve it directly with the Contractor. If unresolved, you may file a dispute through the Platform.

  2. Company’s Role: AtYourStep may mediate disputes but is not obligated to do so. Any decisions made by AtYourStep are final and binding.

  3. Compensation: If AtYourStep determines that compensation is due to you, the Contractor will bear the full cost of such compensation.

10. Release of Liability

To the maximum extent permitted by applicable law, you acknowledge that AtYourStep acts solely as a platform to connect you with Contractors. We are not responsible for the quality, safety, or legality of the services provided by Contractors. You release AtYourStep, its affiliates, officers, agents, and employees from any claims, damages, or liabilities arising from your use of the Platform or interactions with Contractors.

11. Prohibited Activities

You agree not to:

  1. Use the Platform for illegal or unauthorized purposes.

  2. Harass, abuse, or discriminate against Contractors or other users.

  3. Attempt to negotiate or pay for services outside the Platform.

  4. Provide false or misleading information when booking services.

12. Amendments to Terms

AtYourStep reserves the right to modify this Agreement at any time. We will notify you of changes by updating the "Last Updated" date at the bottom of this document. Your continued use of the Platform after such changes constitutes your acceptance of the revised terms.

13. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the Province of Alberta, Canada. Any disputes arising from this Agreement will be resolved through final and binding arbitration under the Simplified Arbitration Rules of the ADR Institute of Canada, Inc.

14. Indemnity

You agree to indemnify and hold AtYourStep harmless from any claims, damages, or liabilities arising from your use of the Platform, your interactions with Contractors, or your violation of this Agreement.

15. Termination

AtYourStep reserves the right to suspend or terminate your account at any time, with or without notice, if you violate this Agreement or engage in conduct that we deem inappropriate or harmful to the Platform or its users.

16. Miscellaneous

  1. Entire Agreement: This Agreement and the Contractor Terms and Conditions together constitute the entire agreement between you and AtYourStep.

  2. Severability: If any provision of this Agreement is found to be invalid, the remaining provisions will remain in full force and effect.

  3. Waiver: Our failure to enforce any provision of this Agreement does not constitute a waiver of that provision.
